中文摘要：	专利的维持是专利获得法律保护的前提，也对专利的商用价值有着重要影响。从专利维持角度对专利进行分析，可以更加全面地了解专利的技术研发和竞争状况。是否维持专利主要取决于权利人对维持的成本与收益的计算。如何确定合适的高校专利维持时间和维持战略，从而使高校专利能够最大限度地为学校创收，同时为社会带来最大的价值，对于高校专利的可持续发展具有极为重要的意义。 为了解决这一问题，本文在已有专利维持和专利战略研究基础上，对我国三大经济圈内的“985工程”高校1985～2006年间的发明/实用新型/外观设计专利维持状况进行调查，使用EXCEL、SPSS等进行综合分析，结果显示我国高校实用新型和外观设计专利授权率较高，而发明专利授权率相对较低。相对来说，发明专利维持的基础没有实用新型和外观设计专利广。专利维持时间方面，无论是发明专利、还是实用新型或者外观设计专利，其总维持时间均未达到专利法规定有效期的一半时间。并且分析结果显示，我国发明专利从申请到授权所需时间约为4年。另外，高校的专利实施率和转移率不高。 针对高校专利维持现状的不理想状态，笔者提出了高校专利维持战略，包括专利维持战略的规划、实施以及调控。规划过程由专利维持战略研究小组、专利价值评估、专利信息分析、专利维持战略的制定、专利维持数据库、专利的实施、专利的转移组成。实施以专利维持的现实收益或预期收益不低于维持的成本，且收益越高越好为原则，做出是否维持以及如何维持的决策。调控包括对专利维持战略的反馈和控制。
英文摘要：	Patent maintenance is a prerequisite for the protection of the law, and has a significant impact on the commercial value of the patent. Analyzing patents from the perspective of patent maintenance can acquire a more comprehensive understanding of the status of technical R & D and patents competition. Whether or not maintain the patent rights depends largely on the comparison of costs and benefits. It is of great importance for the sustainable development of colleges and universities to determine the appropriate patent maintenance time and strategy in order to maximize income of colleges and universities and at the same time bring about the greatest social value of the patent. In order to solve these problems, based on the existing research of patent maintenance and patent strategy, this paper has investigated the status of the maintenance of the patent for invention, utility model and appearance design of 23 universities of "985 Project" in three major economic circles of our country from 1985 to 2006. A comprehensive analysis by EXCEL and SPSS shows that the rates of utility model and appearance design of colleges and universities are higher, while of invention is relatively low. Relatively speaking, the basis of the patent maintenance for utility model and appearance design is more massive than of the patent maintenance for invention. The total time of maintenance of patent rights of the three kinds of patent does not reach half of the validity period regulated by the law of the patent. The duration of patent rights in general is a little short. The results of the analysis also indicate that grand period of invention is about 4 years which is a little long. In addition, the implementation rate and the conversion rate of the patent of colleges and universities are generally low. Because the status quo of of patent maintenance of colleges and universities is not satisfying, this paper proposes the patent maintenance strategy, including the planning, the implementation and regulation of it. The planning process is made of a research team of the strategy, the patent valuation, patent information analysis, patent-keeping strategy, patent maintenance databases, the implementation of the patent, and patents transfer. The implementation programs should ensure that the reality revenue or anticipated earnings of patent rights maintenance is not less than the cost to maintain the patent, and the income is the higher the better. Eventually, whether or not maintain the patent rights, and how to maintain it has been made. Regulation measures include the feedback and control of the patent maintenance strategy.
