中文摘要:在互联网经济飞速发展的背景下,出现了很多新型的以互联网共享平台业务为基础的企业,这些企业改变了旧有的商业模式的同时也改变了企业的人力资源配置方式,从而打破了工业时代构建的雇佣机制,人力资源管理配置方式发生了很大的变化。然而截止到目前为止,学术界并没有从理论分析的视角去分析劳动契约与劳务契约下人力资源配置网络化的模式。本文试图以劳务契约与劳动契约为视角,去分析这两种视角下人力资源配置的网络化模式的不同特征,并做出理性的分析评价。从劳务契约视角来看,在法律与政策规定上对这种劳务契约模式也存在“制度空白”,但是这种挂靠式雇佣的劳务契约模式确实已经成为了互联网平台经济劳务契约的一种较为普遍的现象,因此我们应该顺应时代潮流趋势关注这种互联网挂靠式雇佣方式产生的经济背景、在企业中的运行机制和所存在的问题、如何看待和解决等问题,从而发掘人力资源管理在互联网平台经济下雇佣管理机制中的新关注点,促进人力资源管理在互联网经济下的转型。从劳动契约视角来看,现在海尔等传统企业试图用创客化的平台去改造企业内部的管理机制和人力资源配置机制,这种机制会对传统的组织管理造成什么样的影响,会给人力资源管理激励带来什么样的机遇和挑战也是传统企业会思考的重要问题。本文试图以劳务契约和劳动契约为视角去剖析互联网平台经济中的挂靠式雇佣的雇佣模式定位和雇佣模式发展变迁中的历史承接性、雇佣模式运行机制与特点,并结合滴滴打车与海尔“小微”创客平台为例子。列举互联网平台经济下不同雇佣方式的模式下对管理和培训方式、合同签订方式,并结合当代互联网平台经济下的劳务契约问题去思考人力资源配置网络化带来的影响。本文大概分为五个部分:第一部分主要是从历史角度入手,梳理经济模式和雇佣方式的变迁。若想分析互联网平台经济雇佣的问题,应该从农业经济发展到现在的工业经济在到现在的互联网平台经济的发展脉络入手。因为在不同的经济时期,资源的产权和联接方式,经济主体之间的关系,尤其是资源所有者、经营者和劳动者之间的关系,都有着其当时的生产力和社会制度基础,这一部分的写作目的主要是将互联网平台经济模式与传功的农业经济以及工业模式进行一个对照,找出互联网平台经济模式在经济模式发展上的延续性和开拓性,从而为分析互联网平台经济的雇佣模式打下较为坚实的基础。主要是梳理关于雇佣方式的概念,分析不同雇佣方式下的特征、法律规定和适用范围,以及不同雇佣方式之间的优缺点的对照。雇佣方式的不同,劳动者与管理者之间的关系不同。在很多互联网平台经济创业公司,尤其是服务业,服务业的从业人员直接与消费者发生业务联系,当互联网平台经济企业的服务人员侵害消费者利益的时候,互联网平台经济公司是否有着人员管理的责任。在传统的经济模式下,权责关系比较分明,在互联网平台经济下雇佣方式也有着千差万别。这些雇佣方式与人力资源管理有着区别与联系,在工业化大规模生产方式的企业雇佣方式下,劳动者在一个相对封闭的工作空间、有着固定的工作时间,然而在自雇佣方式和半自雇佣方式下,劳动者一定程度上直接获取自己的劳动成果,工作空间和时间更为灵活。现在很多互联网平台经济公司都试图结合人力资源管理方式(例如培训、绩效管理与奖惩措施)去管理第三方员工和自雇佣劳动者,但是因为雇佣方式的区别,使得一些责任问题显得十分模糊。因而我们需要深入的了解各种雇佣方式,和在不同雇佣方下劳动者工作和管理的时空环境,有助于我们理解互联网平台经济雇佣管理问题。第三部分主要是对比劳动契约与劳务契约不同的内涵和特征,归纳出两种雇佣方式下对组织和人力资源管理边界的不同影响。第四部分主要是访谈和梳理文献的方式列举互联网平台经济雇佣方式的管理方式。本文主要是从滴滴打车等租车平台和海尔公司的“小微”创客平台案例去列举常见的互联网平台经济雇佣方式的管理方式,并通过整理新闻、文献和访谈的形式去分析不同雇佣方式下产生的原因、管理的优势和“制度空白”。第五部分是结合现有的互联网平台经济管理方式,去分析现在管理方式可能存在的问题和改进措施。互联网平台经济雇佣方式介于传统的全自雇佣模式和实体经济企业的标准化雇佣模式之间。即在这些互联网平台经济模式下,劳动者并不是完全意义上的企业员工,他们为企业的业务创造直接价值但是又有着相对自由和独立的人身自由权,具体表现在他们很多是一种兼职模式,不用遵循一个企业所有的管理规则,同时他们工作的地点并不局限在企业的确定地理空间边界范围内,工作时间也比较灵活。同时,当这些“特殊”的雇佣者所服务的业务出现了消极事件(比如发生严重侵害消费者利益),互联网平台经济公司的责任边界模糊。尽管人们对互联网平台经济公司是否应该为半雇佣者的行为负责这个问题有着诸多争议,但是这些事件对这些互联网平台经济企业造成了很多不好的社会影响,再加上现在互联网信息的发达,很多负面信息也在扩大化,这些无不影响着消费者对企业的印象和判断,进而影响消费者的选择。因此,我们需要理性的看待发展迅速的互联网平台经济企业,关注他们的管理盲点,尤其是雇佣管理盲点,这为我们研究互联网平台经济管理的新方式和帮助互联网平台经济健康发展提供了启示。
