中文摘要: 随着社会主义市场经济体制的逐步确立和成功加入WTO,对我国的建筑业带来了巨大的影响。为了尽快与国际惯例接轨,融入世界经济潮流,近几年我国建设领域项目管理理论研究和实践探索都取得了很大的进步,政府相关管理部门和国内学术研究界,在引进和推广国外项目管理的先进理论和经验的方面作了大量的工作,目前我国大型建设项目基本实现了项目管理制。 市场经济是法制经济,合同是市场经济的圣经。建设项目施工合同确定了业主和承包方双方的权利和义务,是项目质量、成本、进度等要素实现的书面表示和法律保证,因此合同管理在项目管理中占有重要的地位,但我国建筑施工企业合同管理仍然是项目管理中最为薄弱的环节,在许多工程中,我国的承包商由于合同管理失误造成许多损失,使得我国的施工承包企业面临来自各方的压力而不堪重负。 要提高建筑施工总承包企业的合同管理水平,就得从合同的签订至合同的解除实施全过程的管理。本文结合国内外合同管理的相关理论及研究现状、合同管理的有关法律依据和我国建筑施工企业合同管理的现状,按照建设项目施工合同管理的寿命周期,针对各个阶段合同管理的一般内容、重点和易出现的问题,研究和总结提高合同管理水平的相关方法和措施。矛盾、争议和索赔是在合同管理的过程中是不可避免的,合理的争议处理方式和有效的索赔策略,有利于改善相关方的对立关系和确保总承包方的利益。加强施工企业合同管理,提高合同管理水平,有利于我国施工企业摆脱目前的困境,提高企业的市场竞争能力,有利于规范业主行为和建筑市场经济秩序,促进我国施工企业的健康、可持续地发展。
