中文摘要：	施工合同管理是工程建设项目管理的重要内容，它涉及到项目管理中的多项管理内容，是工程项目的一种集成管理，从工程准备阶段的招投标到工程完工阶段的竣工验收与交付结算，合同管理贯串于施工企业工程项目管理的全过程，对工程项目的成败起着举足轻重的作用。 本文结合园林绿化行业和园林绿化工程特点，以园林绿化施工企业的角度，将现代项目管理理论中的管理原理技术方法应用到园林绿化工程建设的项目合同管理实践中，解决合同管理中存在的问题。研究施工企业如何运用科学有效的合同管理方法，对合同管理中的各环节进行有效控制，并总结出一些具体的合同管理程序，强调施工企业与业主方应在合同关系的基础上建立良好的合作伙伴式关系，最终达到提高园林绿化工程质量，施工企业与业主实现双赢的目的。对园林绿化施工企业有重要的现实指导意义和一定理论价值。为今后施工企业的合同管理工作提供可借鉴的依据。 本文通过对工程建设项目合同管理发展历程的回顾，在对国内外合同管理相关论述的对比分析基础上，借鉴项目全过程管理理论和合作伙伴式关系理论，结合园林绿化项目特点，重点研究了施工企业全过程合同管理的方法，和园林绿化企业争议纠纷的预防方法。 本文结论： 1．总结出施工合同订立阶段施工企业投标过程各阶段存在的问题及应对的方法和程序。 2．明确了以园林绿化项目施工组织设计作为合同履行过程中进度控制、质量控制和成本控制，进行合同管理及施工管理的主要依据。 3．合同纠纷尽可能通过纠纷成本和敌对都较小的“预防”和“谈判”的处理纠纷方式来解决。施工企业与业主建立合作伙伴关系是预防争议纠纷最有效的方法。 4．园林绿化工程项目中相关利益方的合作伙伴关系及由此而产生的合作伙伴式管理是项目各相关利益方因项目而实现互赢的一种最佳方式，基于项目的合作伙伴式关系也是今后处理园林绿化项目新型合同关系的发展方向。 同时，本文的最后对施工企业与业主建立合作伙伴关系进行了实证分析，通过建立合作伙伴的案例分析，将有助于合作伙伴关系在园林绿化施工企业的推广应用。 本文的创新之处在于： 1．将项目管理中全过程管理思想引用到施工企业的合同管理中。 2．本文完全从施工企业的角度来研究园林绿化项目施工合同管理问题，这在国内外合同管理研究中还不多见。 3．提出了园林绿化项目施工企业与相关利益方建立项目合作伙伴式关系是有效预防争议纠纷，实现项目各相关利益方互赢的一种最佳方式，基于项目的合作伙伴式关系是处理园林绿化项目新型合同关系的发展方向。
英文摘要：	Management of construction contracts is important content of the project management. It involves a lot of content about project management. And it is regarded as the integration management of engineering project. Contract management runs through the whole process of project management of construction enterprises and has prominent function to the success or failure of the engineering project, from bidding phase to final acceptance and settle accounts phases. This paper combines landscaping industry and landscaping characteristics and applies the technique method in the project management theory to the landscaping engineering construction from the view of landscaping construction enterprises, which aims to solve the existing problem in the contract management. The paper also involves the study of how the construction enterprise makes use of the scientific contract management method to control each link in the contract management validly. It summarizes some concrete contract management procedures, emphasizes the establishment of the cooperative partnership based on the contract relationship and achieves the goal of improving the engineering quality and gaining the benefit for construction enterprise and owner, which has important value in reality instruction and theory and provides the basis for contract management which can be used for reference. This paper mainly studies the whole process management method of the construction enterprise and preventive method in the landscaping industry dispute through reviewing the development of the engineering construction project contract management, analyzing the related materials at home and abroad, drawing lesson from the theory of project whole process contract management and partnering theory and combining the landscaping project characteristics. Conclusion: 1. Summarize the existing problem and the method and procedure for replying in making a construction contract and a proposal process. 2. Explicate the main basis of carrying on contract management and construction management. It regards the landscaping project construction management plan as the basis of schedule control, quality control and cost control in the procedure of carrying out the contract. 3. The contract dispute should be solved in the way of preventing and negotiating whose dispute cost and the antagonisms are smaller. The partnering relationship between the construction enterprise and owner is the valid method of preventing dispute. 4. The partnering relationship and partnering management are the best ways of gaining the mutual winning for stakeholder. The partnering based on the project is regarded as the development direction in dealing with the landscaping project new type of contract. In the meantime, the paper has an empirical study on establishing partnering relationship between construction enterprise and owner. Through the case study of the partnering, it contributes to the extension of application in landscaping construction enterprise. The characteristics of the paper lie in: 1. It puts forward the idea that it can apply whole process management to the contract management in construction enterprise. 2. The paper studies the landscaping project construction contract management from the view of construction enterprise, which can hardly be found in the study of contract management at home and abroad. 3. The paper puts forward the partnering relationship between landscaping construction enterprise and stakeholder is the best way to prevent the dispute and realize the mutual winning. Therefore, the partnering based on the project is the development direction in dealing with landscaping project new type of contract.
