中文摘要：	信托，是委托人基于对受托人的信任，将财产权委托给受托人，后者依据口头契约或者书面合同，为受益人或者特定的目的而管理或处分信托财产的行为。我国的信托业，是从承接旧中国信托业开始的，随着改革开放和市场化进程的加快，现代信托业开始逐渐兴起。经过政策与市场的检验，在逐步完善的法律法规的指导下，不仅稳定了我国金融秩序、完善了金融衍生品的缺失、弥补了银行对市场支持的不足，更对实体经济的发展与国家的建设提供了强劲的支持，在行业发展的过程中，信托公司也不断的提升自己的市场竞争力，使自身适应市场的竞争与需求。 我国信托业正是在“受人之托、代人理财”的基本定位之下，随着信托业一法三规的出台以及同时期社会资本供需增加明显而迎来了爆发式增长时期，各信托公司在管理资产额、信托业务收入、净利润等均创下了创纪录的增幅。但由于市场的变化、管理的疏漏和监管的严格化等原因的影响，信托业也暴露出了相当多的问题，如信托资产管理不到位、企业内部管理不合规、风险控制不够严谨、系统性风险集中等。这不仅极大的影响了我国金融市场的稳定，且对信托公司的长远发展造成了非常不利的阻碍，因此，对国内外信托业发展的历史和现状进行深入的研究，并找出行业发展与企业自身发展的契合点，为新华信托在新的市场环境下确定其市场定位和发展战略，从而指导企业的展业方向，使其能够在不断变革的市场与政策中找到一条适合公司发展的新道路，是十分必要的。 本文以规范研究为主，并结合数据进行实证研究，全文共分五章。首先从法理学和经济学的角度对信托本身的涵义和特征进行研究，并以信托的四个基本法概念、信托运用灵活性、信托财产运作目的的非强制盈利性、受益人的多元化等多方面来说明了信托的特征，阐明了信托独特的法律特性和实际运用上的优势。接下来对其他信托业发展较为成熟的国家与我国信托业的发展状况进行了比较分析，希望给予对我国信托业与新华信托的下一步发展以启发。然后通过大量数据引出我国信托业现状的分析，用五个角度说明其发展的机遇与面临的困境。接着根据对新华信托本身业务线和经营状况的数据比较，用图表和数据的方式，表明了新华信托在市场竞争中所处的位置，优势和劣势等，并对企业进行具体的SWOT分析。最后，根据实际的情况，构建新华信托未来的发展战略，并提出了多个解决现存问题的方法，以期为企业下一步的转型提供思路。

The trust industry in China, from the beginning to undertake the old Chinese trust industry, with the process of reform and opening up and accelerate market-oriented, modern trust industry began to rise.Through the test?of policy and market,?the?gradual perfection of the laws and regulationsunder the guidance,?not only the stability of?China's financial?order and improve?the?deficiencyof the financial derivatives,?to make up for the?lack of?support?for?the bank?market,?provide a strong?support?for the real economy?development and?the construction of the country,?in?the course of development of the industry.?Companies are also?constantly enhance their?market competitiveness,?adapt itself to the?competition and?market demand. The trust industry in China is under the "basic orientation, entrusted by the generation of financial management", with the increase of the trust industry one law and three regulations and the introduction of the same period of social capital supply and demand is obvious and ushered in the explosive growth period, all trust companies have hit a record increase in the amount of assets, business income, trust management net profit. But because of the strict supervision and other reasons of omissions and changes in the market, the management of the trust industry, also exposed many problems, such as the management of trust assets is not in place, the enterprise internal management irregularities, risk control is not rigorous, systematic risk concentration etc. This not only has a great impact on China's financial market stability, and long-term development of the company caused a very negative obstacles, therefore, in-depth study of the development history and current situation of domestic and foreign trust industry, and find out the meeting point of the development of the industry and enterprise development, to determine its market positioning and New China Trust CO.LTD the development strategy in the new market environment, so as to guide the business development direction of the enterprise, so that it can find a new way for the development of the company in the market and policy changing, it is necessary to. This paper is based on normative research, and combined with the data of empirical research, the thesis consists of five chapters. By studying the meaning and characteristics of the trust itself from the angles of jurisprudence and economics, and to trust the four basic concepts of trust, trust property, use of flexibility to operate non mandatory profitability, diversification and other aspects of the beneficiary to illustrate the trust's characteristics, to clarify the legal characteristics of trust unique and practical application the advantage of it comparative analysis of the development status of other countries following the development of the trust industry is more mature and the trust industry in China, want to give the trust industry in our country and the New China Trust CO.LTD the next step in the development of the enlightenment. Then through the analysis of a large amount of data leads to the status of China's trust industry, the development opportunities and difficulties in five aspects. Then, according to the New China Trust CO.LTD itself business lines and operating conditions of the data, charts and data, show that the New China Trust CO.LTD in the market is competitive position, strengths and weaknesses, and to analyze the specific enterprise SWOT. Finally, according to the actual situation, to build New China Trust CO.LTD future development strategy, and puts forward several methods to solve the existing problems, in order to provide ideas for the next step of the transformation of enterprises.
