中文摘要：	目前全球竞争越来越激烈，在知识经济时代，知识产权的重要作用更加凸显，甚至成为核心竞争力。在汽车产业领域，由于能源危机及环境污染问题的日益严重，发展新能源汽车已经成为一个趋势，而在新能源汽车行业，知识产权尤为重要。由于全球市场的开放，本土汽车面临着国外公司竞争的挑战，并且由于国外汽车技术优势尤其是知识产权优势明显，给国内汽车产业生存构成了威胁。 知识产权作为一个重要的问题，必须十分重视，加强知识产权管理，建立一个较为完整的知识产权制度体系，从知识产权的申请、实施和保护等方面入手，因此，对于汽车企业来说，做好知识产权管理至关重要。本文以A公司为例，运用知识产权相关理论及其在新能源汽车行业的具体应用，首先通过科学、系统、全面的定性和定量分析，分析了汽车产业尤其是新能源汽车产业知识产权的总体情况，发现其在专利方面存在着较大的瓶颈，知识产权研发薄弱，保护不力等问题。针对这些问题，我们提出了专利申请策略和知识产权保护策略，特别是在专利诉讼保护策略上，针对A公司现阶段的专利基础存在的风险，实现通过专利侵权诉讼将竞争对手驱逐处境、诉讼确立市场优势地位等目标。同时针对A公司存在着的侵权风险，通过合理的维权抗辩策略尽可能的规避侵权风险降低后续由于侵权给A公司带来的经济和名誉损失。具体的抗辩理由为现有技术或先用权抗辩，这样即可以规避侵权风险同时也可以给竞争对手一个打击。为更好地解决这一系列问题，通过A公司的具体实践，制定总体实施方案提出方向，实施基础建设来更好地保障这些策略的实施，然后促进其产业化，最终形成一个知识产权应用和转化的产业体系，获得丰厚的利润，获得持久的竞争力。以期促进我国新能源汽车产业更好地发展。
英文摘要：	At present, the global competition is becoming fiercer. Intellectual property right is playing an increasingly important role and even become the core competitiveness of a company in knowledge economy era. In the field of automotive industry, due to the energy crisis and the increasingly serious environmental pollution, the development of new energy vehicles has become a trend. In this process, intellectual property is particularly important. Since the opening of the global market, domestic auto companies face challenge in competition from foreign auto companies who have the technology advantages, especially intellectual property advantages which pose a threat to survival for the domestic auto industry. Intellectual property is an important issue that must be attached great importance by strengthening intellectual property management, establishing a more complete system of intellectual property system, starting from the development of intellectual property, application, implementation to protection, etc. Therefore, to a auto companies, intellectual property management is a crucial work which must to be done. The thesis, takes A company for example , using intellectual property theory and its concrete application in new energy automotive industry , through scientifically, systematically and comprehensive qualitative and quantitative analysis of the intellectual property protection status of the automotive industry , especially new energy automotive industry and found that there are large areas of bottlenecks in this field. such as weak intellectual property development , inadequate protection and so on. To solve these problems, we propose the development and protection strategies of intellectual property, especially the strategy on patent litigation protection based on A company’s current patent risk to realize the target of rivalling expelled through the patent infringement litigation and establishment of market dominant position. At the same time, use reasonable rights defense strategy to avoid the risk of infringement of A company, reducing the subsequent economic and reputation losses. By defensing specific for existing technologies or the first right to defense can avoid the risk of infringement. At the same time it can also attack the competitors. To better address this issue, we take A Company’s concrete practice for example, who develop the overall implementation plan, build up infrastructure to better protect the implementation of the strategies, promote the industrialization of the intellectual property, and ultimately form an intellectual property application and transformation system which help the company gain profits and sustainable competitiveness.
