中文摘要:近年来,劳务派遣用工作为一种新兴用工形式,被越来越多的应用到企业用工之中。劳务派遣的用工方式,具有一定的复杂性,因此劳务派遣用工一直是人力资源研究领域较为关注的方面。随着我国的法制体系建设的不断深化,我国的相关法规对劳务派遣用工制度的立法规范也在不断的深化。2007 年,我国《劳动合同法》颁布,转年在全国范围内实施,对于劳务派遣相关制度在该法中进行了规定。但在立法过程中难以避免会出现空白,对于派遣机构的设立等没有法律约束。相关的立法缺失,导致我国的劳务派遣用工在实务中往往会存在很多争议和纠纷。 2012 年12 月28 日,国家相关部门通过了修订劳动法的决定。2013 年7 月 1 日,我国颁布了最新的《中华人民共和国劳动合同法》(以下简称“《新劳动法》”)。《新劳动法》里明确规定了“临时工”(包含派遣工)只能在“临时性、辅助性、替代性”的岗位上使用,并和用人机构“正式劳动合同工”同工同酬。换言之,我国现行的相关法律更加严格规范了企业的劳务派遣用工行为。我国的商业银行在用工过程中也广泛存在着使用劳务派遣人员的情况。商业银行作为我国金融领域中重要的一个环节,它的劳务用工一方面会对我国社会劳动力的吸纳起到很大的作用,另一方面不论是商业银行的正式员工,还是商业银行的劳务派遣用工,其用人的素质均会对商业银行的整体经营水平和服务社会的水平产生影响。本文将分析ABC 银行天津分行劳务派遣用工状况,并从劳务派遣用工占比、劳务派遣用工从事岗位、劳务派遣用工待遇等多个角度分析ABC 银行天津分行劳务派遣用工近年来的发展趋势。并希望通过相关分析总结目前 ABC 银行天津分行在使用劳务派遣用工过程中的先进方式及可以改进的方面,寻找商业银行使用劳务派遣用工的最佳方式。
