| 中文摘要: | 劳动关系是最基本的社会关系和生产关系,在不同的历史阶段,劳动关系反映着不同的政治特征、经济情况及文化背景,同时也影响着国家的政治、经济和其他社会关系。可以说,劳动关系的状况反映了一个国家社会进步和现代化发展的程度。我国加入WTO后,随着经济全球化和改革开放进程的加快,外资企业在我国国民经济中的地位不断提高,已成为不可忽视的经济主体。外商直接投资对经济发展、就业、贸易收支以及技术转移等方面有积极的效果。外资企业受不同文化以及制度等因素的影响,形成不同类型的劳动关系。积极的合作的劳动关系会促进企业的稳定发展,消极的对立的劳动关系会影响企业的健康发展。如果处理不好外资企业的劳动关系,没有建立有效的劳动关系管理机制,也会削弱外商直接投资的积极效果。近年来在外资企业中出现的劳资纠纷等劳动关系问题,不仅损害员工的劳动权益,也影响外资企业的健康发展;而且,既会影响投资者的投资决策和退出决策,也会影响潜在投资者的投资决策。因此,外资企业的劳动关系问题已成为政府、劳动者以及外商投资者共同关心的重要问题。本文选取笔者服务的,在华投资近20年的韩资L企业作为样本(准确的说,L公司属中韩合资企业,合资股份中方占20%,韩方占80%,但企业经营全权由韩方负责)。首先,从劳动关系相关理论概述出发,论述了劳动关系的内涵、特征、层级结构,企业劳动关系管理理论,以及外资企业劳动关系的特点等。其次,对在华投资外资企业劳动关系现况的普遍性进行了分析,进而对L企业的劳动关系现况、存在问题、问题形成原因、劳动关系影响因素、劳动关系运行机制、以及劳动关系对L企业的影响等进行了具体研究,最终,提出了L企业构建和谐劳动关系的策略。关键词:劳动关系 外资企业劳动关系 影响因素 | |
| 英文摘要: | Labor relationship is the most basic social relations and the productive relations. In different historical stages, labor relationship not only reflects different political characteristics, economic condition and cultural background, but also affects the country's politic, economy and other social relations. It can be said that the status of the labor relationship reflects a country's level of the social development and modernization. After China's joining into the WTO, along with the speeding up of economic globalization and the reform and opening-up, the status of the foreign capital enterprise in the national economy has constantly improved, and the foreign capital enterprise has become an important economic subject. Direct foreign investment has a positive effect on economic growth, employment, trade balance and technology transfer, etc. Effected by the different culture and institutional factors, different types of labor relations formed in foreign capital enterprise. Positive and cooperative labor relations will promote the stable development of the enterprise, negative and appositive labor relations will affect the health of the enterprise development. If labor relation’s processing is not good, nor there is no effective labor relation management system, it will weaken the positive effect of foreign direct investment Labor disputes and other problems of labor relations in foreign capital enterprise, not only damage the labors’ rights and interests of employees, but also affect the healthy development of foreign capital enterprises. Moreover, labor disputes not only affect the decisions of investment and retrieve, but also affect the decisions of potential investors' investment. Therefore, the labor relation of foreign capital enterprise has become the most essential problem which was concerned by government, labors and the foreign investors together. This article takes the Korea L corporation the author serviced as a sample, which has invested in China for 20 years.(Actually, L is an China and South Korea joint venture company ,China shares 20%,,and the south Korea shares 80%.The South Korea part is responsible for all operations). Firstly, starting with the introduction to the theory of labor relation, this paper discusses the connotation and characteristics of labor relations, hierarchy structure, enterprise labor relations management theory, as well as the characteristics of the foreign capital enterprise labor relations and so on. Secondly, the universality of labor relations status of the foreign capital investment enterprise in China was analyzed, then the labor relations of L corporation status, problems, forming reason, the factors that affect labor relations, operation mechanism, and the influence of labor relationship of L Corporation were carried on the concrete research. In the end, the author put forward the strategy of how to build a harmonious labor relation of the L Corporation.
