| 中文摘要: | 在年初保险监管工作会议上保监会项主席指出了保险行业存在的问题,指出今后的监管思路是“抓服务、严监管、防风险、促发展”。为此,保监会下决心、出重拳自2012年开始要治理保险公司的违规问题,提高保险公司违规成本,保护保险消费者的合法权益。在保监会严监管的形势下,深入研究诚中英信的合规管理现状,针对公司存在的合规问题有针对性进行改善以降低监管风险具有十分重要的现实意义。同时,相关改善方案对于其他保险公司也具有一定的借鉴意义。 论文主要采用案例分析方法,通过过去两年监管处罚数据分析,指出了保险行业普遍存在合规问题。分析了诚中英信的发展状况、合规管理架构、产品特点及销售渠道特点,通过2012年保监会要求的数据真实性检查及销售误导检查过程中发现的合规问题,从保险行业大环境的影响,合作的第三方兼业代理机构以及公司内部三个角度分析了诚中英信存在合规问题的主要原因,提出对内应进一步建立合规文化;加强公司管理层、员工及销售人员的合规培训;完善合规管理架构;在分公司总经理的绩效考核指标中加入合规指标;加大各项政策制度的落实力度;适当调整产品结构;对银行品质管理提出要求等实施方案。 实施方案计划分三个阶段逐步完成。实施方案中确定了每个方案的实施部门。文中对实施方案的难点进行了分析,并确定了保证方案实施的措施。为了引起管理层的注意,文中对可能存在的风险进行了披露。 作者提出保险行业合规工作需要国家、中国保监会、人民银行以及各家保险公司的共同努力。诚中英信也应该从理顺公司的内部控制制度入手,强化各种政策制度的落实,通过培训及责任追究等多种方式,在公司内部建立依法合规的经营理念。 论文的创新之处在于提出了在分公司绩效奖金指标中加入保单品质管理指标、定期推出面向全体员工的合规资讯、要求银行销售人员在销售过程中录音、将回访结果与银行手续费挂钩等举措。 | |
| 英文摘要: | In the meeting of annual insurance supervision hold in the beginning of 2012, Mr. Xiang, the chairman of CIRC, raised the problems that exists in insurance industry, and pointed out that the way of supervision is to providing service, stringent supervision, avoiding risks and promoting development. Therefore, since 2012, CIRC has made up its mind to carry out strict measures to tackle the noncompliance of insurance companies so as to protect the interest of the insurance consumers. In this situation, it is significance to research the compliance status of Cheng Zhong Ying Xin deeply and draw up solutions to decrease the supervision risk. Besides, the solutions can be used for reference to other insurance companies. The method of case study is used in the paper. Popular compliance problems are pointed out, through the data analysis of supervision punishment for the past two years. The developing status, compliance management chart, features of products and sales channels of Cheng Zhong Ying Xin are offered in the paper. In the process of self-check on financial data authentic and anti-misleading requested by CIRB, compliance issues are found. The writer analysis the main reasons for the noncompliance issues from the effect of insurance industry, the cooperation agencies and internal company and put forward implementation plans, including further build up compliance culture, enhance trainings to management and staff, perfect compliance management chart, add compliance indicators in branch GM’s preference system, increase the fulfilling strength for all polices, adjust product composition properly, propose the quality request to banks. The implementation plan is planned to be carried out in three stages. The departments which need to take actions also appointed in implementation plan. The difficulties and the protection measurements for the plan are also provided in the paper. The risk to implement the plan is exposed to management. The writer point out that compliance work needs to make joint effort by nation, CIRC, PBOC and insurance companies. Cheng Zhong Ying Xin should also establish compliance awareness in company by rationalizing internal control systems, enhancing the fulfilling strength for all policies, compliance trainings and making accountability. The innovation raised in this paper include adding policy management indicators in branch performance bonus, publishing compliance information to staff regularly, requesting bank salespersons to keep record in the sales process, integrating bank commission payment to the result of happy call. | |
