| 中文摘要: | 建筑行业是关系国计民生的支柱产业,随着建筑市场的竞争日益激烈,一些影响行业健康发展的问题逐渐凸显。牌照租赁是很多建筑企业普遍存在的一种经营行为,并已成为建筑市场的“潜规则”,然而从长远发展的角度来看,牌照租赁经营行为对于建筑企业以及整个建筑市场都是不利的。遏制和治理非法牌照租赁现象,对于建筑市场的可持续发展具有重大意义。本文从建筑企业M公司出发,分析M公司的牌照租赁经营行为对M公司自身、其他市场主体以及整个建筑市场所造成的负面影响,并从宏观背景、行业环境以及微观主体三个层面深入分析产生牌照租赁现象的原因,最后对完善建筑企业牌照租赁现象的治理机制提出政策性建议。本文提出:首先要加强建筑市场法制建设,健全相关法律法规,并推行工程担保机制和招标代理机制。其次是要完善建筑市场监管体系,强化行政监管,加大执法检查力度,同时要鼓励和引导企业转变落后的经营模式。另外还要从调整资质标准、重新划分资质类别、完善审批流程以及加强动态管理四个方面,完善建筑行业资质管理制度。最后要建立建筑市场信用体系,完善信用法律体系建设,积极培育和促进信用中介机构以及信用行业协会的发展,并完善建筑市场的信息平台。 | |
| 英文摘要: | Construction industry is one of the pillar industries in our economy which is very important in people’s livelihood. With fierce competition in the construction market, some problems that hinder development of the construction market are becoming sharper and sharper. License leasing is prevalent in many construction enterprises and has become an unspoken rule. In the long run, it is harmful for construction enterprises and the market. It is significant for sustainable development of the construction market to contain the phenomena of license leasing. This research, taking company M as an example, analyze the negative effects on company M itself, other market subjects and the entire market of license leasing behavior, and explore the reasons from the levels of macroscopic background, industry environment and microcosmic level, then makes some policy suggestions about how to improve the governance mechanism of license leasing of construction enterprises. The dissertation suggests as following: First, tighten up the legal system and carry out construction bond system, as well as bidding agency system. Second, complete the supervision system, strengthen administrative supervision, intensify law enforcement and guide construction enterprises to change backward business models. Third, improve the qualification regulation system by adjusting qualification standards, modifying qualification categories, simplifying approval process and strengthening dynamic management. Last, build the credit system, complete credit legal system, positively cultivate and promote the development of credit agencies and credit association, and complete the information platform. | |
