中文摘要：	建设工程规模庞大工期长久，执行过程中存在著各式风险，无法于合同签订时可以完全预见而事先规范清楚，因此工程合同纠纷的发生是难以避免的，根据工程纠纷处理文献及纠纷索赔成功案例调研结果显示，合同双方所提出的证据文件是纠纷解决胜败关键的所在。一般实务上工程项目文档的管理方式并未全方位考量建设工程项目执行过程中所产生大量文件的功能及特性，导致于日后工程纠纷处理时无法适时地针对不同工程纠纷提出关键性具有证明能力之工程文件。有鉴于此，本文以工程纠纷解决为目的，研究在工程执行过程中如何做好合同文件档案的建设与管理。本论文经由文献及案例的研究，详细整理工程项目合同文件的内容，依管理者及工程阶段分析文件档案与管理之独特性，归纳整理工程合同纠纷类型与合同证据文件之间的关连性，研究后发现糾紛解決的建設工程項目合同文檔建設與管理是全过程及跨领域的知识管理，是随著纠纷型态、业主的要求、合同的关系、工程实际情况等因素而改变，必须在施工过程中以工程纠纷解决的角度切入工程項目合同文档的管理核心，由具备成本概念、时程概念、法律概念及对于工程争议事件具有敏感度之管理人员，以工程专业知识为基础配合法律专业知识的应用，依工程实际状况一点一滴慢慢累积蒐集，才能提供内容完整、佐证能力强的证据文件。因此本文研究以常见之工务管理组织架构为基础，开展以纠纷解决为目的工程项目合同文件系统管理架构，在施工过程中以动态方式建设与管理工程纠纷文档，具体成果包括： 1.提出糾紛解決的建設工程項目合同文檔分类架构模式，将工程合同文件以争议举证为目的开展纠纷证明文件之分类建设与管理。 2.提出糾紛解決的建設工程項目合同文档建设管理动态执行架构，针对工程纠纷事件所需文档实施管理，以提供完整及有效的纠纷证明文件为目标。 最后经由实际案例验证本文所提出之建設工程項目合同文档的建设与管理模式确实在工程纠纷解决时可提出较为完整的佐证文件资料，被纠纷裁决者采纳作为判断的依据，提高工程纠纷索赔获得经济补偿的成功机率。
英文摘要：	Due to infrastructure construction is time consuming and the construction period is long, there are various risk embedded and it is hard to prevent and be regulated ahead of time in the construction contract; therefore, construction contract dispute is difficult to be avoided. Based on the history of Construction Dispute resolving record and various case studies, justified documentation presented under the construction contact terms is the key to the settle the dispute for contractor. In real practice, a general documentation management can’t precisely cover all the functions and characters written record during the construction period, the result lead to a less powerful proof to be used at dispute settlement. In light of this situation, this thesis is targeting to settle possible construction dispute by establishing and building a reliable documentation management. By conducting documentary and case studies, this thesis analysis the terms and conditions of the construction contract, and concluded various type of construction disputes and the links to contract documentation proof. After the studies, it’s clear to understand the construction documentation management is a cross-area knowledge management; it will also vary with the types of dispute, owner’s requests, contract relationship, and construction in reality. It has to be carefully embedded with managers who are highly sensitive to cost and time management, law and construction disputes background to be involved in the construction, so the proper personnel can collect and record the scenarios during the construction period and build up a reliable database for proofs of possible dispute settlement. This thesis starts from popular construction management as a foundation, and develops a construction contract management system to settle construction dispute. The key conclusions are: 1. Propose a construction contract documentation management system to raise proper proof and categorize those under proper document sections during the construction period. 2. Propose a contract documentation management execution frame to raise proper proof and categorize those under proper document sections during the construction period. Lastly, implement the proposed construction contract document management systems into construction practices and justify that when a construction dispute is filed, the higher successful compensation can be achieved if the contractor keep proper data collection and documentation during the construction period.
