中文摘要:1980年《律师暂行条例》颁布,中国律师制度恢复。1997年《中华人民共和国律师法》实施,尤其是伴随着中国走向市场经济的步伐,中国律师业逐渐脱离对国家经济和编制等的依赖,实现了律师职业社会化。同时,通过律师协会的建立和完善,律师自治及行业化管理逐渐形成。由此,较为规范的律师制度基本形成,律师队伍进一步壮大。 应该说,近几年中国律师业取得了长足的发展。 但是,在全球经济一体化的今天尤其在加入WTO后,中国律师业现有的商业模式已经无法充分挖掘其战略资源更无法突现其核心竞争力;这就直接导致当下的中国律师事务所已无法满足日趋成熟和规范的法律服务市场的需要。尤其是我国已经明确了中国法律服务市场允许外国律师事务所在中国设点,法律服务市场的竞争日渐激烈,特别是金融危机的负面影响更加剧了竞争的程度,对于国内事务所怎样与历史悠久实力雄厚的国外律师事务所竞争并占据主动,成为许多律师事务所不得不面对的问题。同时,我们也注意到中国“十一五”规划纲要明确提出了拓展和规范律师法律服务,大力发展包括法律服务在内的现代服务业,明确了中国律师业的发展战略。包括:诚信战略、规范化战略、产业化战略、信息化战略、品牌战略。归根结底,要实现律师业更快更好的发展,其主旨在于要求律师事务所必须形成自己的核心竞争力,而核心竞争力的形成则要求律师事务所必须充分挖掘自己特有的战略资源。本文结合中国律师事务所的现状与发展,进行中国律师事务所基于战略资源的开发与运用,从而力求充分发掘中国律师事务所特有的战略资源,及相关资源的提升途径。 通过本文的分析和探索,希望有助于聚焦中国律师事务所目前战略定位从而有助于战略资源的提升;从而提升中国律师事务所的综合竞争力,以有效面对激烈的法律服务产业的超强竞争,进一步实现长远可持续的健康发展。相信本文的观点和具体主张,能够为中国律师事务所基于战略资源的开发与运用以及今后的发展战略实施等工作起到一定的参考作用。  
英文摘要:In 1980, after “The Temporary Regulations for Lawyers” was published, the legal system for lawyers was re-established. In 1997, “The Law for Lawyers in the People’s Republic of China” was implemented. With the development of China’s market economy, the legal profession became more organized and independent. Within the last few years, the conditions in this profession are much improved. However, because of the current economic globalization and China joining the WTO, China’s legal system was not able to function efficiently enough to meet the growing demands. Especially when China allowed foreign legal firms to open branches in China, local firms faced huge challenges and competition. In the next five years, the Central Government is going to encourage the legal profession to fully mature. The new policy will require lawyers to establish “trustworthiness”, “regulatory control”, “profession conduct”, “effective information handling” and “a world-class reputation”. In order to be better developed in a short term, the law firms have to build up their own core competitive ability which requires them to fully work on their own special resources according to the new policies and strategies. This thesis will focus on the central core resources of an enterprise and how it can be applied to addressing the issues of development of Chinese lawyer profession. The points and the discussion of this thesis are focusing on the development and using of the strategic resources of Chinese law firms. The hope is that this thesis will contribute to the development of the management and growth of Chinese law firms.
