中文摘要: | 由于受到全球化和信息化的影响,企业需要为其雇佣机制增加更多的弹性,以适应国内外高度的竞争压力。人力派遣不但提供企业所需要的劳动力弹性,还可以帮助其提升自身的竞争力,并且可以帮助员工实现弹性化的需求。因此人力派遣在各国都取得了很大的发展,但是人力派遣这种雇佣方式也改变了传统的劳动关系。由于国内对于人力派遣立法的缺失并在派遣业发展良莠不齐的情形下,派遣员工的利益不能得到相应的保护,劳动争议案件层出不穷。因此,本研究的研究主题是探讨在人力派遣这种新型雇佣方式下的企业劳动关系问题。 本研究采用文献研究、历史研究和比较研究等方法,清晰的界定了人力派遣的内涵、兴起背景和发展动因及其现状和所产生的影响;并在此基础上分析了人力派遣的运行机制和劳动关系特征,概括并总结了人力派遣方式所引发的劳动关系问题,最后根据我国的现行状况提出相应的解决措施和办法。 通过上述研究,本研究发现人力派遣方式下的劳动关系具有其独特的特征:第一,劳雇双方的雇佣需求发生了变化;第二,劳动关系的属性发生了变化,即派遣员工与派遣机构及要派企业之间建立的心理契约不再是关系型而是交易型;第三,由于派遣机构的介入,使得人力派遣下的三方劳动关系非常复杂。同时,本研究进一步概括和分析了由于这种特殊的劳动关系特征所引发的劳动关系问题,即雇主责任不明确问题、差别待遇问题以及雇佣不安定问题。最后,在总结国外成功经验的基础上,本研究提出了解决人力派遣方式下劳动关系问题的对策,即在政府层面完善相应的立法,帮助企业明确雇主责任。 | |
英文摘要: | In recent years, social and economic environments have changed radically. Due to the increase of international competition, variation of business structures, revolution of inter-net technology and diversity of work context, many types of employment are not confined within the structure of "typical employment". New kind of employment, called "atypical employment", has been created. And employee dispatching is the most special one. Employee dispatching not only could offer labor flexibility to corporations, raise them competition, but could also make employees’ flexibility come true. So in these recent years, employee dispatching has been developed a lot in many countries, and it also changed labor relations of traditional employment. Because of the missing of related dispatching laws and the uneven performance of dispatching agencies, the benefits of dispatching workers can not be protected, and labor controversy come up very often. So the theme of this thesis is to explore the labor relations related problems of employee dispatching. The thesis uses some research methods, such as literature research method, historical research method and comparable research method. It clarify the meaning of employee dispatching, the developing contexts and reasons, it also conclude the actualities and the impacting of employee dispatching. Then it analyzes the operating mechanism and labor relations characteristics of employee dispatching. And it summarizes the problems of labor relations labor generated by employee dispatching. Finally, the thesis will give some advices of revolutions of these problems. The thesis founded out that the labor relation of employee dispatching has some special character. First, the employment needs of labor and management have both changed; second, the attributes of labor relations also changed from relational psychological contract to transactional psychological contract; third, the participation of dispatching agency makes the labor relations of employee dispatching more complex. Then, it explored the problems generated by employee dispatching, such as the ambiguous of employer responsibility, the inequality of treatment and the unstable of employment. Finally, based on the summary of other countries’ experiences, it bring forward some suggestions, such as perfect the related law by government and clarify the employer responsibility of dispatching agency and user company. | |
