中文摘要:公共建设具有投资大、风险高、回收慢等性质,虽然未必所有公共工程都有很高的报酬率或自偿率,但它们都可以创造出相当大的外部效益与社会利益。政府为了加强民间参与重大公共建设,近年来致力于引进国外盛行民间参与公共建设之模式,希望藉由这种新兴的公私部门合作方式,引进民间技术、能力及效率,以提升公共建设质量,并增进社会福祉。 为了加强民间参与公共建设计划之意愿,政府提供了多种奖励措施,包括:协助民间取得私有土地、提供长期资金融资以及租税优惠等。政府提供这些实质的奖励措施,无非是因为公共建设本身具有促进公益的目的,藉由公共建设提供之公共服务,使全民获益。另一方面,为了避免民间业者所追求之私益与政府机关所代表之公益无法平衡,政府部门对于该公共建设之兴建、营运事项,施以适当之监督,使民间兴建之公共建设,能够建全与持续的运作,以达到公益与私益兼顾之「双赢」局面。 本论文共分十章,除第一章绪论与第十章结论与建议外,其余八章:第二章从民间参与公共建设之相关理论和实践回顾与评析开始,第三章探讨政府对民间参与公共建设分类与战略控制,第四章探讨风险管理与分担,第五章研讨政府对民间参与公共建设的法律规范架构,第六章探讨政府对民间参与公共建设的协商谈判,第七章探究办理的核心流程与控制,第八章分析财物评估与激励,第九章案例解析。 在迈向国家建设现代化与经营企业化的时代,政府与民间企业适当分工合作为时势所趋,以政府之公权力制订国家基本政策及建设方向,并给予民间足够的奖励诱因,配合民间企业充沛的活力、经营的创意、快速反应的决策能力与效率,除可大幅加速国家建设的脚步外,并可藉此有效建立政府与民间企业分工合作的模式,进而强化与提升国家整体竞争力。 相关重大公共工程之推动有其迫切性与必要性,民间参与公共建设也有相当多的优点,然而考虑国内既有社经环境与现存政府体制等方面的限制,如要形成一个既有效率、又重效能的政府与民间平行合作机制,是一个充满挑战的历程,也需要政府与民间充分努力合作,以发展出高效率的重大公共工程推动模式。 本研究提出了包括战略控制、风险分担、法律规范、协商谈判、流程控制与评估激励六个方面的政府对民间参与公共建设管理体系的理论框架。 透过上述六个方面理论框架,体验实践民间参与公共建设之管理战略,尤其实践过程中民间参与业者与政府所面临之各种风险管理与分担。 政府对民间参与公共建设必需建立其法律框架规范,在法律框架下进行各种协商、谈判、法制、建立退场机制,以及各种流程控制管理战略;以期如期营运,并适时移转,达成政府及民间双赢局面。  
英文摘要:Infrastructures have the properties of vast investment, high risks and slow rewards. Although some infrastructures cannot get high return on investment or self-sufficiency, but they can produce amounts of external and social benefits. In order to strength private parts to participate in infrastructure, government introduces the model of private participation in infrastructure. By means of the cooperation between public sectors and privates parts, it can recommend private technique, ability and efficiency to promote the quality of infrastructure and increase the social welfare. In order to enhance the willing of private participation in infrastructure, government provides some reward measures including assisting private parts to get the private land, to supply the long term loan and tax preference. Government supplies the reward measures to enhance the social welfare and to get the benefits for all peoples. On the other hand, in order to avoid imbalance between private benefit and social welfare, government sectors supervise the Build-Operate- Transfer of the infrastructure to operate soundly and consistently so that it can get win to win to both sides of social welfare and private benefit. This dissertation divides into ten chapters. Besides the first chapter introduction and the tenth chapter conclusion, the second chapter discusses the relative theory and reflection of private participation in infrastructure. The third chapter investigates the categories and strategy control of private participation in infrastructure. The fourth chapter investigates risk management and share. The fifth chapter investigates the structures of law, specification .The sixth chapter investigates the management of agreement and negotiation. The seventh chapter investigates the core process and control of the implementation. The eighth chapter analyzes the financial estimation and stimulation.The ninth chapter introduces some analyses of BOT examples. Toward the ages of construction modernization and management enterprising, it is the tendency that government and private work together cooperatively on projects but doing different things. Government draws up the elementary policy and construction direction by means of civic rights and gives the incentive induce to the private parts that both sides can harmony with full vigor, management innovation and quickly response of decision ability and sufficiency. Only doing this, it can accelerate the construction step to construct the cooperative model of government and private and to strength, promote the national competition. It is urgent and necessary to accelerate the relatively important construction. Private participation in infrastructure has so many advantages. But to consider the constriction of social, economical environment and government system, it is a challenge process to form the cooperative mechanism to the both sides. This study offers six parts of theoretical framework that government manage to govern the private participation in infrastructure system: strategy control, risk share, law specification, agreement and negotiation, process control, estimation and stimulation. By way of the above six framework, we can exercise and implement the process of risk management and share by privates and government. Private participation in infrastructure must establish the law and specification framework. Under the law framework, government and private can undertake variety of negotiation, agreement, law, retreat mechanism, process control, and management strategy. By doing this, we hope the private participation in infrastructure can build, operate, transfer to government in time and reach the target of win to win by both private and government.
