| 中文摘要： | 近年来，劳务派遣这种用工形式迅猛发展，劳务派遣公司更是遍地开花，法律的滞后性使劳务派遣公司的经营行为完全靠自律，造成涉及劳务派遣公司的劳动争议激增，劳动关系的基础受到考验。在建设和谐社会、保证劳动者体面就业的大环境下，随着《劳动合同法》的贯彻实施，劳务派遣公司的经营风险越来越大，建立经营风险控制系统是关系到劳务派遣公司生存和发展的紧要问题。 本文以XZ公司作为研究对象，XZ公司是天津劳务派遣行业的先行者，经历了天津劳务派遣的全过程，对它的研究具有典型意义。XZ公司从成立到现在，一直在夹缝中生存，面临着诸多风险，怎样控制经营风险好好活下去是XZ公司每天都要面对的问题。 本文从实际案例入手，对XZ公司的经营风险进行了归类，并运用风险控制理论对造成这些风险的原因及其控制方法进行研究，建立起经营风险控制系统，对经营风险进行事前控制、事中控制和事后控制，促进XZ公司健康发展。 通过研究，本文认为，“以被派遣劳动者为本”是劳务派遣公司建立经营风险控制系统的出发点和落脚点，同时也是劳务派遣行业作为正规就业的补充能够存在和发展下去的基础。下一步，准备在实际工作中根据这一观点，不断完善XZ公司的风险控制系统，使派遣业务更规范、更专业。欢迎各方面的批评指正，希望能起到抛砖引玉的作用，能对其他派遣公司有借鉴意义，能对劳务派遣行业的健康发展贡献一点儿微薄的力量。 | |
