| 中文摘要: | 在数字经济全面渗透、社会数字化转型加速与司法体系在线化改革的宏观背景下,传统律师事务所诉讼服务流程普遍面临效率不足、协同不畅、智能化水平偏低等现实困境。W律师事务所作为区域性中型律所,诉讼业务体量较大、流程依赖度高,但现有流程仍以人工与纸质化为主,数字化程度不高、智能化应用薄弱,难以适应外部数字化环境与行业竞争要求。本文以W律师事务所诉讼服务流程为研究对象,综合运用文献研究、案例分析、实地调研与对比分析等方法,立足流程优化相关理论,系统梳理流程现状、识别关键痛点,从内部数字化缺口和外部数字化环境倒逼双维度深入剖析成因,构建一套覆盖全流程、兼具信息化与智能化、可落地实施的数字化流程优化方案。 研究表明,W律所诉讼流程问题是内部数字化能力不足与外部数字化环境强制适配共同作用的结果。内部层面存在系统建设滞后、技术应用浅层化、人员数字技能薄弱、管理与激励机制不完善等短板;外部层面面临司法全流程在线化、电子证据普及、客户线上服务需求提升、同业数字化竞争加剧等压力,内外因素叠加凸显流程适配性不足。现有数字化应用多停留在基础信息化阶段,智能化应用明显不足,未能充分发挥人工智能、大数据、区块链等技术在案件评估、文书生成、证据管理等环节的赋能价值,与高阶数字化转型存在差距。 基于上述分析,本文构建涵盖六大核心模块的数字化、智能化优化方案,强化智能初评、智能文书、智能风险预警等智能化内容,推动流程从信息化向数字化、智能化深度转型。同时设计分阶段实施路径、资源配置计划及配套保障机制,确保方案具备落地可行性。研究通过与行业标杆数据对比表明,该方案具备显著提升案件处理效率、降低运营风险、改善客户体验与律所核心竞争力的优化空间,为同类中小律所数字化转型提供可复制范式,既弥补特定情境下流程优化的研究不足,也具备较强的实践应用价值。 | |
| 英文摘要: | Against the macro background of the comprehensive penetration of the digital economy, the acceleration of social digital transformation, and the online reform of the judicial system, the traditional litigation service processes of law firms are generally faced with practical difficulties such as insufficient efficiency, poor collaboration, and low level of intelligence. As a regional medium-sized law firm, W Law Firm has a large volume of litigation business and high process dependence, but its existing processes still rely mainly on manual work and paper-based operations, with low digital level and weak intelligent application, which makes it difficult to adapt to the requirements of the external digital environment and industry competition. Taking the litigation service process of W Law Firm as the research object, this thesis comprehensively adopts methods such as literature research, case analysis, field investigation and comparative analysis, based on process optimization theories, systematically sorts out the current situation of the process, identifies key pain points, deeply analyzes the causes from two dimensions: internal digital gaps and external digital environment constraints, and constructs a full-process, informatization and intelligence integrated, implementable digital process optimization plan. The research shows that the problems in the litigation process of W Law Firm are the result of the joint action of insufficient internal digital capabilities and the mandatory adaptation of the external digital environment. At the internal level, there are shortcomings such as backward system construction, superficial technology application, weak digital skills of personnel, and imperfect management and incentive mechanisms; at the external level, it faces pressures such as the full onlineization of judicial processes, the popularization of electronic evidence, the improvement of customers' demand for online services, and the intensification of digital competition in the industry. The superposition of internal and external factors highlights the insufficient process adaptability. The existing digital applications are mostly at the basic informatization stage, with obvious lack of intelligent applications, failing to give full play to the enabling value of artificial intelligence, big data, blockchain and other technologies in case evaluation, document generation, evidence management and other links, which is different from high-level digital transformation. Based on the above analysis, this thesis constructs a digital and intelligent optimization plan covering six core modules, strengthens intelligent contents such as intelligent preliminary evaluation, intelligent documents and intelligent risk early warning, and promotes the in-depth transformation of processes from informatization to digitalization and intelligence. Meanwhile, a phased implementation path, resource allocation plan and supporting guarantee mechanism are designed to ensure the implementability of the plan. The research, through comparison with industry benchmark data, shows that this plan has significant optimization space for improving case handling efficiency, reducing operational risks, enhancing client experience and the core competitiveness of the law firm, provides a replicable paradigm for the digital transformation of similar small and medium-sized law firms, makes up for the research deficiencies in process optimization under specific scenarios, and has strong practical application value. | |
