| 中文摘要: | 在当前全球汽车产业竞争日趋激烈的背景下,新能源汽车作为新兴且迅猛发展领域,其知识产权的布局与诉讼活动已成为行业瞩目的焦点。随着技术的持续革新和市场需求的不断增长,新能源汽车产业正迎来前所未有的变革与机遇,但与此同时,知识产权纠纷也随之增多,企业间的专利诉讼频发,进一步凸显了知识产权在该领域的关键作用。因此,加强专利保护与运用,不仅能为企业的创新成果提供坚实的法律保障,激发其创新活力,推动新技术的研发与应用,还能帮助企业构建核心竞争力,提升市场地位,实现可持续发展。深入研究新能源汽车领域的专利保护与运用策略,对于企业应对复杂多变的知识产权环境,以及为新能源汽车产业的健康发展提供有力支撑,具有至关重要的意义。 Z公司是一家央企背景科技咨询公司,2016年开展知识产权业务,经过多年的高速发展,逐渐成为汽车知识产权行业的领军企业。但是由于全球经济增速放缓、汽车行业竞争激烈,Z公司的知识产权业务发展也面临着不少挑战与问题。因此如何制定正确的竞争战略以保证在日趋激烈的市场竞争中保持持续的竞争优势就显得尤为重要。 本论文将以Z公司知识产权业务为案例作为研究,通过梳理迈克尔?波特竞争战略及其他相关理论与文献,运用PEST、波特五力模型、企业资源与能力、产业生命周期分析工具分析企业面临的政治、经济、文化、技术环境、竞争环境、竞争优势、所处的产业生命周期阶段。通过Z公司战略定位及对迈克尔?波特三种竞争战略进行可行性分析,最后得出最适合Z公司知识产权业务的竞争战略是集中差异化竞争战略,同时明确了Z公司选择集中差异化战略的优势与风险。最后通过对Z公司价值链细分及价值活动驱动因素分析,明确了Z公司在品牌、技术及营销上构建价值链的难以模仿性,从而建立Z公司知识产权业务价值的稀缺性。并提出了Z公司在制度、组织、企业资源方面的战略实施的保障措施。 本论文从汽车产业和知识产权业务相结合的视角出发,为相关领域的研究提供了新的视角和思路。运用企业资源与能力理论从集团到公司垂直一体化分析,将文献研究、案例分析和数据分析、系统分析多种研究方法相结合,不仅针对当前存在的问题提出了具体解决方案,还结合未来发展趋势提出了前瞻性的建议。本文对Z公司知识产权业务竞争战略分析,旨在为Z公司持续的经营发展提供竞争优势建议,同时对知识产权行业发展也有借鉴意义,有助于推动中国新能源汽车产业高质量发展。 | |
| 英文摘要: | In the context of the increasingly competitive of global automotive industry, the layout and litigation activities of new energy vehicles, as an emerging and rapidly developing field, have become the focus of the industry. With the continuous innovation of technology and the continuous growth of market demand, it will bring unprecedented changes and opportunities to the new energy vehicle industry , but at the same time, it also increases of intellectual property disputes, and patent litigation between enterprises, the key role of intellectual property in this field s is more prominent,. Therefore, strengthening the protection and application of patents can not only provide a solid legal guarantee for the innovation achievements of enterprises, stimulate their innovation vitality, and promote the research and development and application of new technologies, but also help enterprises build their core competitiveness, enhance their market position, and achieve sustainable development. In-depth research on patent protection and application strategies in the field of new energy vehicles is of vital significance for enterprises to cope with the complex and changeable intellectual property environment and provide strong support for the healthy development of the new energy vehicle industry. Z company is a technology consulting company with state-owned enterprise background, which began to carry out intellectual property business in 2016, and after years of rapid development, it has gradually become a leading enterprise in the automotive intellectual property industry. However, due to the slowdown of the global economy and the fierce competition in the automotive industry, the development of Z company’s intellectual property business is also facing many challenges and problems. Therefore, it is particularly important to formulate the right competitive strategy to ensure that it maintains a sustainable competitive advantage in the increasingly fierce market competition. This thesis will take the intellectual property business of Company Z as a case study, by combing Michael Porter's competitive strategy and other related theories and literature, and using PEST, Porter's five forces model, enterprise resources and capabilities, and industrial life cycle analysis tools to analyze the political, economic, cultural, technological environment, competitive environment, competitive advantage, and industrial life cycle stages faced by enterprises. Based on the strategic positioning of Company Z and the feasibility analysis of Michael Porter's three competitive strategies, it is finally concluded that the most suitable competitive strategy for intellectual property business of Company Z is the focused differentiation competitive strategy, and the advantages and risks for the choice of Company Z with centralized differentiation strategy are clarified. Finally, through the analysis of the value chain segmentation and the driving factors of value activities of Company Z, it is clear that it is difficult to imitate the value chain of Company Z in terms of brand, technology and marketing, so as to establish the scarcity of the value of Company Z's intellectual property business. And put forward the safeguard measures for the strategic implementation of company Z in terms of system, organization and enterprise resources. From the perspective of combining the automotive industry and intellectual property business, this thesis provides new perspectives and ideas for research in related fields. Using the theory of enterprise resources and capabilities to analyze the vertical integration from the group to the company, the literature research, case analysis, data analysis, and system analysis are combined, and the specific solutions to the current problems are not only proposed, but also forward-looking suggestions are put forward in combination with the future development trend. this thesis analyzes the competitive strategy of Company Z's intellectual property business, aiming to provide suggestions for the competitive advantage of Company Z's sustainable business development, and at the same time, it also has reference significance for the development of the intellectual property industry, which is conducive to promoting the high-quality development of China's new energy vehicle industry. | |
