中文摘要：	大数据时代，数据作为信息时代的新型资产在经济、社会运作和组织管理中发挥着重要作用。然而，屡屡出现的数据违规出境、侵犯公民个人信息隐私权益等事件让我们意识到数据合规面临着重重挑战，企业亟待加强数据合规治理，实现政府监管下的良性发展。因此，本文旨在从政府规制视角出发，为企业提供数据合规治理指引和对策。 本文基于内容分析法和案例研究法，对2014年-2024年十年间数据合规方面共计35项中央法规和37项地方法规文本展开研究。首先，笔者梳理了政府规制与企业数据合规领域的文献、政策法规资料，并对法规文本展开内容分析。笔者从企业数据合规出发，搜集了敏感或个人信息保护合规、数据安全保护合规、数据制度建设合规和跨境数据流动合规四个方面的法规文件，经编码分析得到企业数据合规风险要素和治理标准的二级、三级指标，并在此基础上搭建企业数据合规治理框架。随后，笔者基于滴滴事件相关新闻报道和相关访谈数据资料，并结合前文政府规制视角下的数据合规治理框架，对滴滴出行的数据不合规风险和困境开展案例研究。最后，笔者基于上述研究提出企业数据合规治理的对策建议。 本研究得到以下结论：一是政府应该从加强顶层设计、加强行业引领、完善法理基础、加强数据合规人才建设、加设监管机构、加强数据出境有关法规建设六个方面提升企业数据合规；二是企业应该从加强企业数据合规制度建设、建立企业合规审查和自查机制、加强平台用户监督管理和加强数据出境审查四个方面实现企业数据合规治理能力提升。
英文摘要：	In the era of big data, data has become a crucial asset in the information age, playing a significant role in economic operations, social functions, and organizational management. However, frequent incidents of unauthorized data transfers and violations of citizens' privacy rights highlight the numerous challenges facing data compliance. Enterprises urgently need to strengthen data compliance governance to achieve sustainable development under government regulation. This study aims to provide guidelines and strategies for data compliance governance from the perspective of government regulation. Based on the content analysis method and case study method, this paper studies the text of 35 central regulations and 37 local regulations on data compliance from 2014 to 2024. Firstly, the literature, policies and regulations in the field of government regulation and enterprise data compliance were sorted out, and the content analysis of the regulatory texts was carried out. From the perspective of enterprise data compliance, the author collected four regulatory documents including sensitive or personal information protection compliance, data security protection compliance, data system construction compliance and cross-border data flow compliance. Through coding analysis, the second-level and third-level indicators of enterprise data compliance risk factors and governance standards were obtained, and the enterprise data compliance governance framework was built on this basis. Then, based on the relevant news reports and interview data of Didi incident, and combined with the data compliance governance framework from the perspective of government regulation mentioned above, the author carried out a case study on the data non-compliance risks and difficulties of Didi Chuxing. Finally, the author puts forward countermeasures and suggestions for enterprise data compliance governance based on the above research. This study obtained the following conclusions: First, the government should improve enterprise data compliance from six aspects: strengthening top-level design, strengthening industry guidance, improving legal basis, strengthening the construction of data compliance talents, adding regulatory agencies, and strengthening the construction of relevant regulations for data exit. Second, enterprises should enhance their data compliance governance capabilities from four aspects: strengthening the construction of enterprise data compliance system, establishing enterprise compliance review and self-inspection mechanism, strengthening the supervision and management of platform users, and strengthening data exit review.
