中文摘要：	FIDIC合同条件被视为工程承包的圣经，被国外建筑企业广泛采用。虽然我国于20世纪80年代引入了FIDIC合同条件，但不常参与海外项目的承包商对此合同条件了解甚少。随着WTO保护期的结束，越来越多的国外投资商或建筑承包企业将进入我国建筑市场，我国建筑业企业将面临越来越激烈的竞争。目前被广泛采用的最低价中标办法也促使企业在激励的竞争环境下，过于关注业绩，在投标过程中集中精力研究报价，主观上忽略了招标文件中的各类要求，从而使企业在中标后面临许多合约风险。 本文首先回顾了风险、合约风险以及风险管理的相关理论，对前人的研究做了适度的归纳和总结；简要介绍了FIDIC合同条件的宗旨、订立原则和特点，重点介绍该合同条件中涉及各利益相关方的条款内容。其次，本文将工程项目按时间划分为三个阶段，分别对这三个阶段存在的合约风险及其成因进行较为深入的分析，继而再阐述各阶段风险的控制措施。最后，本文对实际项目合约条款暗藏的风险进行分析，结合典型案例印证论点。 本文将在一定程度上唤起项目管理者对合约风险的重视，同时也为建筑承包企业对FIDIC合同体系下的合约风险管理提供了合理规避和转移风险的办法以及若干实用性的建议措施，为承包商识别、控制及处理合约风险提供参考和借鉴依据，有利于提高建筑承包企业的项目管理水平和盈利能力。
英文摘要：	FIDIC Conditions are regarded as the Bible of project contracting，and it has been widely used by foreign construction enterprises. Although the FIDIC Conditions had been pulled in our country in 1980s’，the contractor who not always to participate the overseas projects doesn’t know it well. So these contractors usually fall into the passive position because they unfamiliar with FIDIC Conditions when they worked on the projects that operated in FIDIC Conditions. As the protection term of the WTO came to a close，more and more foreign investors or foreign contracting enterprises will enter Chinese construction market. Our contractors will face more and more fierce competition. In this competitive environment，the contractor usually concern about the performance excessively，because the principle of lowest quoted price for winner is usually adopted. In the bidding process，they spend too much time on the tender price，so they can not put their attention on the tender requirements. So the risk waiting for them after they win the bid. Firstly，this thesis reviewed the theory of risks and risk management，summarized previous studies of FIDIC Conditions，briefly introduced the purpose，principle and features of FIDIC Conditions，comprehensively described the clause that relevant to all related parties. Secondly，this thesis divides project into three stages which include bidding，construction and completion. We deeply analyzed the risk and the cause of the risk of every stage respectively，and then bring forward the measures of risk control. Finally，this thesis give a real case proof on the opinions had been argued above. This thesis will make the project managers know the importance of risk of contract. At the same time，it not only offered some useful methods of avoid and transfer risk of the project which operate under the FIDIC system reasonable，but also provided some basis of risk identification and control. It will help the contractors to raising the environmental management level and profit capability of projects.
