| 中文摘要: | 近年来,在知识经济愈发显著的社会背景下,专利成为企业参与市场竞争的重要工具。然而,随着专利数量的迅猛增加和专利技术的日益复杂,企业极其容易陷入专利陷阱,从而面临巨大的专利纠纷风险。因此,如何做好专利预警工作,成为企业亟待解决的热点问题。 本文通过梳理国内外相关文献资料,发现专利所处不同技术生命周期对专利预警的准确度存在一定影响。因此,在现有研究的基础上,本文以技术生命周期为理论基础,对企业专利预警机制展开研究。研究聚焦的企业专利预警机制主要包含三个部分:预警指标体系的构建、预警状态的判断,以及预警策略的提出。首先,研究从专利质量、研发、技术、法律、市场五个维度选取企业专利预警指标,运用层次分析法为预警指标确定权重,最终形成了技术萌芽期、技术成长期、技术成熟期的专利预警指标体系;其次,本文给出了判断企业专利预警状态的具体路径;再次,基于企业专利预警状态,本文结合专利所处技术生命周期,帮助企业完成专利策略的优化。 最后,研究选取华为技术有限公司为实证对象,以智慧芽专利数据库为主要专利数据检索平台,对企业近10年的专利数据进行分析,并以技术成长期、技术成熟期的预警指标对已获数据展开专利预警,最终得到相应年度的专利预警状态,验证了各技术生命周期专利预警机制的可行性。研究还结合企业的实际情况,给出了适合企业后续发展的专利策略。 | |
| 英文摘要: | Under the background of knowledge economy, patents have become an important tool for enterprises to participate in market competition. However, with the rapid increase in the number of patents and the increasing complexity of patented technologies, companies are extremely easy to fall into the patent trap. Therefore, how to do a good job of patent early warning has become a hot issue for enterprises. Through combing relevant domestic and foreign literature, this paper finds that different technology life cycle of patents have a certain impact on the accuracy of patent early warning. Therefore, on the basis of the existing research, this paper studies the enterprise patent early warning mechanism based on technology life cycle. The enterprise patent early warning mechanism mainly includes three parts: the construction of early warning indicator system, the judgment of early warning status, and the proposal of early warning strategy. First of all, the research selects enterprise patent early warning indicators from five dimensions of patent quality, R&D, technology, law and market, and uses the analytic hierarchy process to determine the weight of early warning indicators; Secondly, this paper gives the specific path to judge the patent early warning status of enterprises; Thirdly, based on the early warning status of enterprise patents, this paper combines the technology life cycle of patents to help enterprises complete the optimization of patent strategies. Finally, the research selected Huawei Technologies Co., Ltd. as the empirical object, to conduct patent early warning on the past 10 years patent data, finally obtained the patent early warning status of the corresponding year, which verified the feasibility of the patent early warning mechanism of each technology life cycle. Based on the actual situation of the enterprise, the research also provides a patent strategy suitable for the subsequent development of the enterprise. | |
