中文摘要: 在知识经济时代,当前世界正由物化商品向非物化商品发展。知识产权成为企业最有价值的资产。如何有效构建知识产权战略并在知识产权竞争中赢得优势是我国企业必须面对的一个重大现实课题。 本文以战略管理理论、资源基础理论、知识管理理论、价值链理论为基础,整合文化、领导、创新、知识产权等领域的理论,目的是构建一个具有创新性和可操作性的企业知识产权战略理论框架,以提高企业知识产权战略实施的有效性。 首先,从战略管理理论视角出发,通过系统的文献研究,结合目前我国企业知识产权的实践,对我国企业知识产权的发展阶段进行了分析和研究,指出了未来一段时间内我国企业知识产权战略发展的思路。根据目前我国企业知识产权的状况及国内外知识产权竞争环境的变化,对我国企业知识产权战略环境(优势、劣势、机会和威胁)进行了深入的分析和研究;提出了企业知识产权战略定位的九项基本原则,指出了企业知识产权战略定位的基点,探讨了我国企业知识产权战略模式的选择;对企业知识产权战略定位的主体及行为机制进行了深入的分析和研究,界定了战略定位主体的范围,分析了战略定位主体的作用及战略参与的流程,提出了企业知识产权战略定位主体的四种机制。 其次,借鉴价值链、知识管理等理论研究的成果,综合运用基础理论演绎和实证研究方法,构建了企业知识产权价值链分析模型,对知识产权价值链的内涵进行了界定,提出了知识产权价值链的五个基本特征。指出了知识产权价值链模型由知识产权运作过程中的关键活动和战略支持体系两部分组成,该模型将知识产权战略实施过程更加系统化、明确化,有机地将知识产权运作流程及支持体系与企业核心能力连接起来。重点研究了企业知识产权的获得、管理、运用和保护四种活动,提出了企业知识产权管理体系模型、知识产权运用模式及营利模式转化的模型,把知识产权价值链的每一个关键活动与企业竞争优势连接起来。通过以资源和利益分析为导向,利用成本和差异化,降低知识产权运作成本,减少知识产权风险,形成位势障碍,提高知识产权战略实施的效率和效果,进而形成企业的持续竞争优势。 最后,为了充分了解企业知识产权战略实施的具体实践,作者对河南和天 I 摘 要 II 津共20多家企业进行了相关的调查并发放了一些问卷,对其中较为典型的三家企业进行了深度访谈。用知识产权价值链模型对该三家企业知识产权战略实施的具体实践进行了分析和研究,针对存在的一些问题进行了具体的剖析。 企业知识产权战略问题不仅关系到企业的竞争力问题,而且还关系到国家竞争优势问题。本研究对我国企业在新形势下提高知识产权的获得、管理、运用和保护意识,构建企业知识产权竞争优势,具有非常重要的理论意义和现实意义。 
英文摘要: In an era of knowledge economy time, the present world is developing from material goods towards non-material goods. The intellectual property rights (IPR) become the most valuable assets. How to construct IPR strategies and win advantages in the IPR competition is a major realistic issue lying before Chinese enterprises. This dissertation is based on strategic management theory, resource-based views, knowledge management theory, and value chain, and integrates these theories in culture, leadership, innovation, and IPR with an aim to constructing an innovative and operateable theoretical framework for IPR strategies to improve the effectiveness of IPR strategic implementation. Firstly,from the strategic management perspective, based on a literature review, and in combination of the practice of Chinese enterprises, this dissertation analyzes the development stages of IPR in China and proposes the idea for the strategic development of IPR in a certain period of time. In the light of the status of Chinese IPR and the change of IPR competition at home and abroad, this dissertation make a SWOT analysis of the strategic environment of IPR in China, proposes 9 basic principles for the strategic positioning of IPR as well as the base point of the positioning, probes the selection of the strategic models of IPR, studies the main body and functioning mechanism of the position, defines the scope of the positioning main body, analyzes the roles of the main body and the strategic participation process, and proposes 4 mechanisms of the positioning main body of IPR. Secondly, in reference to the research results of value chain and knowledge management, and in combination of theoretical development and empirical methodologies, this dissertation constructs a model of analyzing IPR value chain, defines the connotation of IPR value chain, and proposes 5 basic characteristics of IPR value chain. An IPR value chain consists of critical activities and strategic support during the IPR operation process. This model makes the IPR implementation process more systematic and clearer, combining the IPR operation process and support system with the core competence. It mainly analyzes the specific activities to acquire, manage, utilize, and protect IPR, proposes the management system model, utilization pattern, and business model transforming pattern of IPR, and connects each of the critical activity of IPR value chain with the competitive advantage. Oriented III Abstract towards resources and profit analysis and with the help of cost and differentiation strategies, an enterprise can reduce the running costs and risks of IPR, form the station barrier, and improve the effectiveness and efficiency of IR strategic implementation, thus obtaining the sustainable competitive advantage. Finally, to make a full understanding of the practice of IPR strategic implementation, the author makes a field and questionnaire investigation of over 20 companies in Henan and Tianjin, and makes an in-depth interview with 3 typical enterprises. The author utilizes the IPR value chain model to analyze the practice of IPR strategic implementation of the 3 enterprises as well as the main problems existing in the 3 enterprises. IPR strategies affect not only the competence of enterprises but also the national competitive advantages of a country. This research is of important theoretical and practical significance for Chinese enterprises to obtain, manage, utilize, and protect IPR, and construct the IPR competitive advantages.
