| 中文摘要: | 互联网技术革命改变了传统的劳动过程形态,人工智能时代劳动形态的多元化在深入地演化和发展,高度智能化、去中心化以及追求多元价值实现的时代潮流令劳动关系形态更加复杂。劳动形态全面非典型化的演变趋势使现有的相关法律和规范在实践中引发广泛争议和纠纷,既有的劳动法律规范基本只适用于规范标准劳动关系,蓬勃发展的互联网非标准用工市场缺少法律保护,也不利于企业活力的增长和劳动者权利的实质保障。 发达便捷的移动通信和互联网技术使人们不再受制于传统的物理时空限制,时间也更加具有弹性化和即时化等特征。工业化时代,传统的自然时空开始被整齐地进行规制和划分,演变到信息化时代,互联网拓展了人类工作生活的新时空,整齐的时空结构也日渐弥散化和柔性化。时间与空间构成了人们对社会生活的基本感知维度,但时空的分离不断解构着传统劳动过程的时空距离,瓦解着工业化时期劳动的稳定的时空秩序,同时不断塑造着新的劳动形态、劳动过程和劳动关系。劳动者的工作时间、劳动场所、薪资结构以及组织对劳动过程的监督控制都与传统的标准化劳动关系大不相同,平台经济下的非典型劳动关系更加趋于劳动时间的弹性化、用工方式的灵活化和控制手段的数字化。 针对上述出现在互联网背景下劳动管理领域新问题,本研究使用文献研究法、比较分析法、案例分析法等研究方法,尝试回归分析劳动过程本身,通过比较分析工业时代和信息化时代劳动过程的时间和空间结构特征,进而阐述在当今互联网时代背景下新型劳动过程的时空秩序特征和由其引发的劳动过程管理异化问题。之后,选取网络直播行业为例,以前面研究的劳动过程的时空结构为基础分析网络主播劳动过程中时空维度的新特征,探究互联网平台经济模式下从业者劳动过程中的一些异化问题和由此带来的负面影响。最后结合前文的理论模型建构和典型案例分析,提出在人力资源管理领域应对新型劳动过程的一些对策和方法。 | |
| 英文摘要: | The Internet technology revolution has changed the traditional labor process patterns. The diversification of labor patterns in the era of artificial intelligence is in-depth evolution and development. The trend of high intelligence, decentralization, and the realization of multiple values will make labor relations more complicated. The evolution trend of comprehensive atypical labor patterns has caused extensive controversies and disputes in practice with the existing relevant laws and norms. The existing labor laws and norms are basically only applicable to standardize labor relations, and the booming Internet non-standard labor market lacks Legal protection is also not conducive to the growth of enterprise vitality and the substantial protection of labor rights. The developed and convenient mobile communication and Internet technologies make people no longer subject to the traditional physical time and space constraints, and time is more flexible and instant. In the era of industrialization, the traditional natural time and space began to be neatly regulated and divided, and evolved into the information age. The Internet has expanded the new time and space of human work and life, and the neat time and space structure has become increasingly diffused and flexible. The constitutive elements of society are also the core categories of modern social life. The separation of time and space constantly deconstructs the time and space distance of traditional labor process, disrupts the stable time and space order of labor during the industrialization period, and constantly shapes new labor forms, labor processes and labor relations. For example, it is difficult to maintain a relatively stable relationship between workers and employers under the traditional bureaucratic organization and standardized employment relationship, whether it is the way of work, content, time, place, salary and benefits of workers, or the way of providing labor materials and labor. Compared with traditional labor relations, the way of monitoring the process tends to be more flexible, flexible and digital. In response to the above-mentioned new problems in the field of labor management under the background of the Internet, this study uses literature research method, comparative analysis method, case analysis method and other research methods to try to return to analyze the labor process itself. The characteristics of time and space structure, and then expound the characteristics of time and space order of the new labor process and the alienation of labor process management caused by it in the context of today's Internet era. After that, taking the online live broadcasting industry as an example, based on the temporal and spatial structure of the labor process studied earlier, it analyzes the new characteristics of the temporal and spatial dimensions in the labor process of Internet anchors, and explores some alienation problems in the labor process of practitioners under the economic model of the Internet platform and the resulting problems. negative impact. Finally, combined with the previous theoretical model construction and typical case analysis, some countermeasures and methods to deal with the new labor process in the field of human resource management are proposed. | |
