中文摘要：	在全球化背景下，人工智能(AI)、物联网(IOT)等新兴技术的不断涌现，使数字经济全球化成为当下主流发展趋势，但在享受数据流动红利的同时，跨境数据流动的安全问题也伴随而来，数据出境安全成为各个国家的关注重点。确保数据安全关键是理清数据的权属关系，但当前我国对于数据权属界定依旧空白，模糊不清的权属带来权责义务的不明晰和利益分配的不均等，使数据出境中各数据主体冲突不断，数据安全事件时有发生。 基于此，本文提出四个研究问题：数据出境的权利结构是什么？从权属角度来看,它们可能会对国家、企业或者个人带来哪些数据安全问题？导致这些问题的原因有哪些？以及如何保障数据出境过程中个人、企业、国家的数据安全?为解决这些问题，本文首先在回顾数据出境相关政策文献的基础上，以权利束理论构建了由数据人格权、数据财产权、数据主权等组成的数据出境权利束；然后通过个人数据人格权、企业数据财产权、国家数据主权三个权属视角对经典案例展开研究，发现数据出境中存在个人隐私泄露、企业缺乏安全责任意识、国家主权受到威胁等数据安全问题，进一步分析得到引起数据出境安全的原因是企业数据伦理失范和国家数据霸权主义；最后在前文基础上总结我国数据出境安全管理中存在的不足，并分别从个人、企业以及国家层面提出了对策建议，最终目的是形成数据出境多元主体共治的局面，以期在满足各方数据主体利益诉求的同时，保障我国数据出境安全。
英文摘要：	In the context of globalization, the continuous emergence of artificial intelligence (AI), Internet of Things (IOT) and other emerging technologies has made the globalization of digital economy a mainstream development trend. However, while enjoying the dividend of data flow, the security problem of cross-border data flow has also come along, and the security of outbound data has become the focus of attention of various countries. The key to ensure data security is to clarify the ownership relationship of data, but at present, China's definition of data ownership is still blank, ambiguous ownership brings unclear rights, responsibilities and obligations and unequal distribution of interests, resulting in constant conflicts among data subjects in data exit, and data security incidents occur from time to time. Based on this, this paper proposes four research questions: What is the right structure of data exit? From the perspective of ownership, what data security problems might they bring to countries, enterprises or individuals? What are the causes of these problems? And how to ensure the data security of individuals, enterprises and countries in the process of data exit? In order to solve these problems, this paper firstly reviews the relevant policy literature of data exit, and constructs the data exit right bundle consisting of data personality right, data property right, data sovereignty and so on. Then, from the perspective of personal data personality right, enterprise data property right and national data sovereignty, the classic cases are studied. It is found that there are data security problems in data exit, such as personal privacy disclosure, enterprise's lack of security responsibility awareness, and national sovereignty being threatened. Further analysis shows that the fundamental causes of data outbound security are enterprise data ethics anomie and national data hegemony. Finally, based on the above summary data exit to the defects of safety management in our country, and from individuals, businesses and national level respectively puts forward the countermeasures and Suggestions, ultimate goal is to form multiple subject data exit work situation, in order to meet the demands of the interests of the subject of the data at the same time, to ensure the safety of China's outbound data.
