中文摘要:随着互联网技术和产业信息化在中国的快速发展,“互联网+”的模式应运而生,平台化、共享经济等概念渗透到了众多领域和行业,为企业模式带来了新的变化,同时也为雇佣关系带来了影响和挑战。雇佣关系是指受雇人向雇佣人提供劳务,雇用人支付相应报酬形成权利义务关系。与工业时代构建的雇佣机制不同,以提供互联网平台服务为主要业务的企业中出现了越来越多样化的区别于传统雇佣关系的非典型关系,然而截止到目前为止,学术界还未能对这种复杂而混沌的现状进行全面的分析。 虽然美国加州Uber司机对Uber公司提起诉讼要求确认他们员工身份的案件获得胜诉,交通部征求意见稿认定网络预约出租汽车平台公司与驾驶员应该签订劳动合同,但这两个判定都存在一些让人质疑之处。本文审慎的认为这是一种共享经济发展下的劳动关系的中间形态,从劳动关系的认定标准来看组织与人之间的人格从属性减弱,经济从属性仍具有较为重要联结,故而认为互联网平台企业所用之人虽有别于传统的员工但仍具有一定程度员工的属性。因此本文将从非典型雇佣关系的角度去分析互联网平台企业不同模式的人力资源的运用。本文聚焦于互联网平台企业蓬勃发展趋势下劳动力资源被进一步整合与利用的过程,重点关注当今互联网平台企业中“组织”与“人”之间的复杂关系,对一个企业中同时存在合作关系、挂靠式劳务派遣和劳动关系的现状进行分析,并通过梳理这种非典型雇佣关系的演变历程和驱动因素将其划分为不同模式,针对不同模式间的演化和互补总结当前互联网平台企业对各种非典型雇佣关系的模式的选择。此外本文结合“滴滴出行”这一互联网平台企业进行案例分析,系统梳理滴滴出行对于多种非典型雇佣关系模式的综合运用,得出日益复杂的非典型雇佣关系给企业带来的影响、机遇和挑战,并提出人力资源管理相关的展望与应对建议。  
英文摘要:With the rapid development of Internet technology and the industry informationization in China, "Internet +" model arises at the historic moment. And the concept such as platform, Shared economic permeated many fields and industries. It brought the new change for the enterprise, also brought impact and challenge for the employment relationship at the same time. Employment relationship refers to the right and obligation relationship between the employer and the employee to pay the corresponding remuneration. Different from the industrial age employment mechanism, atypical relations from the traditional employment relationship increase and diversify in the enterprise providing internet platform service as the main business, so far, however, the academic community has not yet made a comprehensive analysis of this complex and chaotic situation. Although Uber drivers in California have won the case against Uber for confirming their identity of employees, and the ministry of communications asked for a draft of the opinion that the company should sign a labor contract with the driver, there are still some caveats to both decisions. It is prudent to consider this as an intermediate form of labor relations under the development of a Shared economy. Judging from the criterion of labor relations, the relationship between organization and human personality is weakened, and economic subordination is still more important, so it is believed that the people used by internet platform enterprises are different from traditional employees but still have some attributes of employees. Therefore this paper will analyze the application of human resources in different modes of internet platform enterprises from the perspective of non-typical employment relationship. This paper focuses on the process of further integration and utilization of labor resources under the booming development trend of Internet platform enterprises, and the complex relationship between "organization" and "people" in today's Internet platform enterprises. This paper analyzes the current situation of cooperative relationship, dependent labor dispatch and labor relations in an enterprise, dividing it into different modes by sorting out the evolution process and driving factors of this atypical employment relationship. Based on the evolution and complementarity of different modes, this paper summarizes the current choice of various atypical employment relations among Internet platform enterprises. In addition, this paper combines the case analysis of DiDi, an Internet platform enterprise. Through systematic analysis of DiDi's comprehensive application of various atypical employment relations, the influence, opportunities and challenges of increasingly complex atypical employment relations on enterprises are obtained. And put forward the outlook and countermeasures of human resource management.
